Migrating Paper Archives to the Cloud in Ukraine: Architectural Solutions and Legal Challenges for the Corporate Sector

Ukrainian organizations face an urgent need for digital transformation, particularly in the area of archival document management. Moving paper archives to the cloud not only promises increased accessibility, efficiency, and resilience to physical risks but also presents complex challenges for CIOs, CTOs, and IT operations managers related to selecting architectural solutions and ensuring legal compliance. Balancing the innovative capabilities of cloud technologies with the stringent requirements of Ukrainian legislation is key to the successful implementation of such projects.

Architectural Models for Migrating Archives to the Cloud

The choice of an architectural approach for migrating paper archives to the cloud depends on the organization's scale, data sensitivity, and available resources. There are two main digitization paths: in-house or outsourcing to third-party service providers.

In-house digitization involves establishing an internal scanning department, acquiring equipment, and software. This approach provides full control over the process but requires significant investment and expertise. Once digitized, documents can be uploaded to the chosen cloud storage.

Third-party service provider solutions offer a ready-made package, including scanning, indexing, and data migration. This allows companies to focus on their core business but requires careful selection of a reliable partner who guarantees security and legal compliance.

Regarding the cloud environment, organizations can choose between public, private, or hybrid clouds. Public clouds (e.g., Google Cloud, Microsoft Azure) offer scalability and cost savings but may raise concerns about data residency and control. Private clouds provide maximum control and security but require substantial investment. Hybrid models combine the advantages of both, allowing sensitive data to be stored in a private cloud while less critical data resides in a public cloud.

Legal Validity of Digitized Documents: Challenges and Solutions

One of the most complex aspects of migrating paper archives to the cloud in Ukraine is ensuring the legal validity of digitized copies. According to the Law of Ukraine "On Electronic Documents and Electronic Document Management" No. 851-IV, the legal validity of an electronic document cannot be denied solely because it is in electronic form [5, 19]. However, a simple scan of a paper document without additional certification is not an electronic original and does not have the same legal force [8, 25].

To give a digitized copy legal validity equivalent to the paper original, it must be certified. This is achieved by applying a qualified electronic signature (QES) or a qualified electronic seal (QES seal) by the responsible person or institution [16, 28, 31]. A QES has the same legal force as a handwritten signature and is presumed to be equivalent to a handwritten signature [28]. The use of cloud-based QES is a modern alternative to file keys and tokens, enhancing convenience and security [32].

The procedure for working with electronic documents in record-keeping and their preparation for archival storage is regulated by the relevant order of the Ministry of Justice of Ukraine No. 1886/5 [20, 23, 24, 26, 27]. This document establishes requirements for the creation, processing, and archiving of electronic documents, which is critically important for ensuring their legal significance.

Requirements for Long-Term Storage and Cybersecurity

Ukrainian legislation sets clear requirements for storing electronic documents. According to Article 13 of Law No. 851-IV, electronic documents must be stored on electronic media in a form that allows their integrity to be verified. The storage period for electronic documents must be no less than the period established for the corresponding paper documents [3, 9, 14, 21].

Furthermore, when storing electronic documents, compliance with the following requirements is mandatory: the information must be accessible for further use; the ability to restore the electronic document in the format in which it was created must be ensured; information that allows tracing the origin and purpose of the electronic document, as well as the date and time of its sending or receipt, must be preserved [3, 9, 11, 14, 21]. If storage on a single medium for the required term is impossible, duplication of documents on multiple media and periodic copying are provided for [3, 14].

The issue of data residency is particularly relevant. Although a resolution was recently adopted for state institutions allowing data to be stored abroad in the cloud even after the martial law ends, for the private sector, this decision requires careful analysis and risk assessment [33, 34]. It is important to consider that international cloud service providers operating in Ukraine must comply with certain regulatory requirements and standards to ensure data security [37].

Cybersecurity is an integral part of the cloud archiving strategy. Protecting digitized sensitive documents requires the implementation of robust encryption, access control, monitoring, and auditing mechanisms. Compliance with information protection standards and the requirements of the Law of Ukraine "On Personal Data Protection" must be ensured.

Strategic Choice: A Checklist for CIOs and CTOs

When deciding to migrate paper archives to the cloud, IT leaders and architects should consider a number of critical factors. This checklist will help formulate an optimal strategy:

  • Legal Compliance: Does the chosen approach include certifying digitized copies with a QES/QES seal to ensure their legal validity? Does the archiving process comply with the requirements of Order No. 1886/5 and Law No. 851-IV?
  • Data Classification: Determine the sensitivity level of each document type to select the appropriate security level and cloud model (public, private, hybrid).
  • Cloud Model Selection: Evaluate the advantages and disadvantages of public, private, and hybrid clouds in terms of cost, scalability, security, and data control.
  • Data Residency: Are there legal restrictions on storing certain types of data outside Ukraine? Does the chosen cloud provider allow data to be hosted in Ukraine if necessary?
  • Service Provider Selection: When engaging third-party companies for digitization or cloud storage, verify their certifications, reputation, security policies, and experience with Ukrainian legislation.
  • Integration and Access: How will digitized archives be integrated with existing document management systems (DMS) and other corporate applications? How convenient and secure will user access to archival data be?
  • Cybersecurity and Recovery: Does the architectural solution include robust mechanisms for encryption, backup, data recovery after failures, and protection against cyberattacks?
  • Cost and ROI: Conduct a detailed cost analysis for digitization, migration, storage, and cloud maintenance, comparing it with potential savings and benefits.
  • Staff Training: Ensure staff training on working with new systems and adhering to security policies.

Migrating paper archives to the cloud in Ukraine is a strategic step that requires a deep understanding of both technological capabilities and the complex regulatory landscape. Successful implementation of this project will enable Ukrainian organizations not only to protect their valuable data from physical threats but also to significantly increase operational efficiency and competitiveness in the digital age.
